Terms And Conditions Of Magical Africa

Magical Africa LLC (“Magical Africa”) is a safari company located in California. By booking a safari with Magical Africa, you acknowledge and agree to be bound by these terms and conditions. If you have any questions or concerns, please do not hesitate to contact us. We are always here to help, and we look forward to providing you with a once-in-a-lifetime safari experience.

 

Meals
Three meals daily are included per the tour itinerary, based on evening arrivals. Regional wines, beer, and bottled water are included with meals. Any special dietary requests will be considered and must be made at the time of booking. Any additional meals not included in the tour itinerary are the responsibility of the passenger.

 

Air Transportation
Your travel agent should arrange international flights or Magical Africa can refer you to our preferred provider of air tickets. Internal African flights on safari must be purchased through Magical Africa. All air transportation is subject to availability at the time of booking. Magical Africa is not responsible for any delays or cancellations caused by the airline.

 

Luggage
Magical Africa provides a safari bag that guests are encouraged to use while traveling. On certain flights within Africa, strict luggage restrictions apply. Detailed information about these restrictions will be provided in tour documentation. Luggage and personal effects are at the owner’s risk throughout the tour unless insured. Magical Africa is not responsible for lost or damaged luggage.

 

Wi-Fi and Laundry
Where available, Wi-Fi and laundry service are included in the tour rates. Taxes: The tour rate includes hotel, lodges and Tented Camp taxes imposed by city and state governments, entrance fees to national parks and game reserves, and airport taxes for intra-country flights. International airport taxes are not included in the quoted tour rate.

Not included in Quoted tour/safari rate
The quoted tour/safari rate does not include the cost of obtaining passports, visas, travel insurance, excess baggage charges, items of a personal nature such as communication (calls, faxes, emails, etc.), international airport departure tax (to be paid in U.S. dollars or acceptable foreign currencies), deviations from the tour, gratuities, or personal expenses. These items are the responsibility of the traveler.

 

Registration
A deposit of 30% is required at the time of booking. The balance of the payment is due 120 days before the departure date.

 

Cancellations
Cancellations received by Magical Africa 120 days or more prior to departure are subject to a cancellation fee of 20% of the total retail tour rate. Cancellations received 119-60 days prior to departure are subject to a fee of 50% of the tour rate. Cancellations received 59 days or less prior to departure are subject to a 100% cancellation fee. It is strongly recommended that travelers purchase trip cancellation insurance.

Arrangements
The quoted tour rates include planning, handling, and operational charges, based on the current rate of exchange and tariff as of December 2022. In the event of an increase in foreign exchange or tariff rates, energy or fuel surcharges, or other increases, etc., except for increased governmental taxes which can be assessed at any time, rates are subject to revision up to the time of your final payment to us. In the event of unexpected circumstances, Magical Africa reserves the right to make changes to the tour itinerary. Any changes or substitutions will be made in the best interest of the travelers.

 

Responsibility
Magical Africa LC (known as “Magical Africa”), its employees, shareholders, officers, and directors (collectively “Magical Africa”) does not own or operate any entity which is to or does provide goods or services for the passenger’s trip, including, for example, lodging facilities, transportation companies, local ground or safari operators, including, without limitation, various entities which may utilize the Magical Africa name, guides, entertainment, food or drink service providers, equipment suppliers, etc. As a result, Magical Africa is not responsible for any negligent or willful act or failure to act of any such person or entity. In addition, Magical Africa is not responsible for any negligent or willful act or failure to act of any person or entity it does not own or control, nor for any act or inaction of any third party not under its control. Without limitation, Magical Africa is not liable for any direct, indirect, consequential, or incidental damage, injury, death, financial or other loss, accident, delay, inconvenience, or irregularity of any kind which may be occasioned by reason of any act or omission beyond its control, including, without limitation, any willful or negligent act, failure to act, breach of contract, or violation of local law or regulation of any third party such as an airline, train, hotel, bus, taxi, van, or safari operator, local ground handler, or guide, whether or not it uses the Magical Africa name, financial default, or insolvency of any supplier which is to, or does supply any goods or services for this trip. Similarly, Magical Africa is not responsible for any loss, injury, death, or inconvenience due to delay or changes in schedule, transportation delays or cancellations, or the failure of any transportation mechanism to depart or arrive timely or safely, overbooking of accommodation, default of any third party, attacks or bites by animals, pests, or insects, injury or death while on activities sponsored by lodging facilities or by other third parties, sickness, the lack of appropriate medical care, evacuation to same, if necessary, weather, strikes, acts of God or acts of or orders of government, acts of terrorism, or the threat thereof, force majeure, war, quarantine, epidemics, or the threat thereof, criminal activity, or any other cause beyond its control. In addition, the passenger holds Magical Africa harmless from its own negligence and assumes all risk thereof.

The right is reserved to alter, cancel, or postpone the itinerary or trip, at Magical Africa’s sole discretion, as it may deem necessary or advisable. Magical Africa reserves the right to decline to accept or retain any passenger on any of its tours if, in its sole discretion, it deems accepting or retaining any such passenger as creating a health or safety risk to any person or being detrimental to the tour, or if that person’s continued presence is inconsistent with the best interests of the trip, other passengers, or staff. In the event any passenger is removed from a trip, Magical Africa’s only obligation is to refund to that person that portion of the payment allocable to unused services.

 

Binding Arbitration
Any dispute concerning, relating, or referring to this Agreement, the brochure or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration in accordance with the laws of the State of California and the Federal Arbitration Act, 9 U.S.C. Sections 1-16, according to the then existing Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) California law and will take place in San Bernardino County, California. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. By agreeing to these terms and conditions, you (and we) are waiving our right to a trial by jury. Any arbitration commenced against Magical Africa must be on behalf of only the signatory to this Agreement and his or her immediate family members who travelled with signatory, such as a spouse or child. Under no circumstances can participant be part of a class or other joint action.

 

Indemnification
The passenger (“Passenger”) agrees to indemnify and hold Magical Africa LLC, its employees, shareholders, officers, and directors (collectively “Magical Africa”) harmless from any and all claims, damages, or lawsuits arising out of or in connection with the Passenger’s participation in the trip, including but not limited to: claims for personal injury, death, property damage, or other loss or damage, whether or not caused by the negligence of Magical Africa. The Passenger agrees to assume all risks associated with the trip and to release Magical Africa from all liability for any loss, damage, injury, or inconvenience that may be sustained by the Passenger or the Passenger’s property while participating in the trip. The Passenger agrees to be bound by the terms and conditions outlined in this document and to abide by all laws, regulations, orders, and requirements of the countries visited. The Passenger also agrees to be bound by the terms and conditions of any third party provider of goods or services for the trip, including but not limited to: airlines, trains, hotels, buses, taxis, vans, safari operators, local ground handlers, and guides. If the Passenger is under the age of 18, the parent or guardian of the Passenger agrees to be bound by the terms and conditions outlined in this document on behalf of the Passenger. This agreement shall be governed by the laws of the state of California. Any legal action arising out of or in connection with this agreement shall be brought in a court of competent jurisdiction in San Bernadino County, California.

 

Cancellations and Postponements by Magical Africa
If Magical Africa cancels or postpones a trip due to acts of God or force majeure, acts or orders of government, epidemics or the threat thereof, terrorism or the threat thereof, strikes or labor disturbances, demonstrations, riots or civil unrest, criminal activity, supplier default or insolvency, or other similar circumstances, its sole obligation is to issue credits in the full amount of moneys paid to Magical Africa to the extent its suppliers are crediting Magical Africa with those monies paid by Magical Africa to them. Under no circumstances is Magical Africa obligated to refund the cost of any purchased travel insurance. Magical Africa is not required to cancel any program for any reason including, but not limited to, warnings or advisories issued by the United States Department of State, Centers for Disease Control, World Health Organization, or other similar organizations. Magical Africa is not responsible for fees assessed by air carriers resulting from operational and/or itinerary changes, even if Magical Africa makes the flight arrangements or cancels the program.

 

Miscellaneous
Magical Africa reserves the right to change the listed lodges, hotels, tented camps or attractions in the itinerary to similar options at any time. It is the responsibility of the guest to review relevant travel information provided by the United States Department of State and Centers for Disease Control and Prevention before their trip. These resources can be found at http://www.state.gov/ and http://www.cdc.gov. Any changes to these terms and conditions, responsibility, or binding arbitration agreement must be made in writing and signed by a representative of Magical Africa Safaris.

 

Photography
By participating in a trip with Magical Africa, you grant Magical Africa the right to take photographs or film of you and your participation in the trip. You also give Magical Africa Safaris permission to use these photographs or film for promotional or commercial purposes without any further compensation to you. This permission is granted in perpetuity and may be exercised by Magical Africa Safaris or its assigns.

 

Unused ServicesIf a participant is unable to utilize any portion of the trip services, no refund will be given for those unused services.

 

Supplemental Release of Liability and Assumption of Risk with Regard to COVID-19
This supplemental release is in addition to the Magical Africa LLC (also known as “Magical Africa”) Terms & Conditions, Responsibility and Binding Arbitration Agreement (Agreement). In the event of a conflict between the Agreement and this supplemental release, the terms of this supplemental release will prevail. In all other cases, the Agreement remains in full effect. This supplemental release also applies to any postponed or replacement trip. The passenger (“Passenger”) is aware that while on or traveling to or from the trip, the Passenger may be exposed to COVID-19 from other people, animals, or objects. The Passenger assumes all risk of any such exposures, including illness, incapacity, or death, and agrees to hold Magical Africa harmless from any such developments. The Passenger also acknowledges that the US Department of State and the Centers for Disease Control and Prevention may have warnings about COVID-19 and the Passenger will review these before the trip (see https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html/ and https://wwwnc.cdc.gov/travel/destinations/list/). The Passenger also accepts the following risks of participating on this trip, including but not limited to: (1) all other risks associated with coronavirus (COVID-19), including being excluded from public areas, (2) all risks regarding transportation problems, including but not limited to difficulties entering or exiting a country, and difficulties with or closure of transportation systems or unavailability of other features or attractions within the country where the trip takes place, (3) the likelihood that the Passenger may be required to undergo a temperature check, wear a mask in public, and observe social distancing requirements at some or all destinations, (4) The potential for being quarantined, even if the Passenger is not experiencing symptoms and/or do not have COVID-19, and/or the possible requirement that the Passenger has a negative COVID-19 test before or after arriving at the destination.

The Passenger understands that any expenses incurred as a result, including but not limited to medical expenses, will be the Passenger’s responsibility.
